OFFICIAL SWEEPSTAKES RULES

To Enter:

NO PURCHASE IS NECESSARY TO ENTER THE SWEEPSTAKES. PURCHASE WILL NOT ENHANCE YOUR CHANCES OF WINNING. In accordance with COPPA, all entrants must be at least 13 years of age. To enter simply enter your email address and first name in the form that you viewed promoting the Sweepstakes in its entirety. Alternatively, you may legibly hand-print on a 4" x 6" card the words "'Win Free Candy Sweepstakes" along with your name, address, email address (if you do not have an email address, print "no email address"), date of birth and telephone number and mail the entry to: "Win Free Candy Sweepstakes PO Box 1883 New City NY 10956”. The Sweepstakes will begin at approximately 1200pm EST on April 1, 2003. The deadline for entry receipt is at 12:00am EST on December 31, 2003 and mailed entries must be postmarked by December 31, 2003 and received by January 15, 2004. All names, addresses and email addresses entered must be valid or will be void. All entries become the property of YourFreeCandy.com (hereinafter YourFreeCandy). YourFreeCandy is not responsible for lost, late, incoherent, incomplete, misdirected, any electronic miscommunications or failures, technical hardware or software failure of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions which may limit an entrant's ability to participate in the Sweepstakes.

Eligibility:

ALL ENTRANTS AGREE TO ABIDE BY THESE OFFICIAL SWEEPSTAKES RULES.

This Sweepstakes is open to any legal resident of the United States (excluding U.S. possessions, territories, overseas military installations, and Puerto Rico). Participants must have on-line access as of the start date. All entrants must be at least 18 years of age or older to be eligible for this Sweepstakes. Minors under the age of 18 may enter the Sweepstakes with the permission of, and under the name of, their parent or legal guardian who will be the official entrant of the Sweepstakes. Employees of YourFreeCandy, its affiliates and subsidiaries, or companies or organizations directly related to this Sweepstakes, and members of their immediate families (mother, father, sister, brother, grandmother, grandfather) and members of their households are not eligible to enter the Sweepstakes. Only entrants logging onto the Internet from the United States are eligible to enter the Sweepstakes. Void where prohibited or restricted by law. All federal, state, and local laws and regulations apply. YourFreeCandy reserves the right, at its sole discretion, to disqualify any entry if it concludes that the entrant has tampered with the entry process or the operation of the Sweepstakes or has acted in violation of the official rules or any applicable federal , state, or local laws or regulations.

Privacy:

Sponsor collects personal data from you when you enter this Sweepstakes. This information becomes the property of YourFreeCandy, and may be distributed to other parties for marketing purposes. Please review Sponsor's privacy policy at http://privacy.coverclicks.com. For all online entries, you also agree to receive offers from YourFreeCandy.

Winner Selection:

The winner of the prize will be selected in a single random drawing on January 15, 2004. Odds of winning the prize are determined by the number of eligible entries received. Winner will be notified by email. YourFreeCandy will attempt to contact winners via email a maximum of three (3) times within five (5) business days of the drawing. For mailed entries, YourFreeCandy will attempt to contact winners by phone a maximum of three (3) times during business hours (9:00am to 5:00pm EST) within five (5) business days of the drawing. If winners do not respond within two (2) business days of the final contact attempt, YourFreeCandy will conduct a new random drawing, the winner of which will receive the corresponding prize. This process will continue until either all prizes have been awarded or no valid entries remain, whichever occurs first.

Prize:

Fifty (50) winners will receive 2 pieces of candy. Estimated value of each prize (2 pieces of candy) is $.10.

All taxes and incidental expenses not mentioned herein are the responsibility of the winner. Winner must agree to execute an affidavit of eligibility to ensure that the winner meets all of the eligibility requirements set forth in the rules and must also sign a release of liability stemming from the winner's participation in the sweepstakes. No substitutions are allowed. Winner should allow one (1) to two (2) weeks for shipment of prize.

General Conditions and Releases:

By entering the Sweepstakes, entrants release and hold harmless YourFreeCandy , all affiliates and subsidiaries of such entities, their employees, agents and representatives from any and all losses, damages, rights, claims, and actions of any kind in connection with the promotion or resulting from acceptance, possession, or use of any prize, including, without limitation, personal injuries, death or property damage, and claims based on publicity rights, defamation, or invasion of privacy, incomplete, garbled, misdirected, or delayed electronic entries, damages caused by the unauthorized downloading of information from YourFreeCandy by a "hacker" or other unauthorized user of YourFreeCandy's computer systems. By entering the Sweepstakes, entrants and winners consent to the use of their names, addresses, likeness and any statements they make in connection with the Sweepstakes or about YourFreeCandy without additional compensation, except where prohibited by law. Winners may be required to execute an affidavit of eligibility and a liability/publicity release that must be received by YourFreeCandy within 14 days of the time it is sent by email or regular mail to the winner. Failure to respond to the prize notification or to return the affidavit and liability/publicity release on time will result in the loss of the prize and an alternative winner will be selected in accordance with the procedures set forth in these rules. Sponsor reserves the right, in its sole discretion, to suspend or cancel this Sweepstakes at any time, for any reason including but not limited to computer virus, bug, worms, tampering, unauthorized intervention, fraud or other technical problem, security, or other problems or activities. In the event of cancellation, YourFreeCandy reserves the right to award the prize in a random drawing from all entries received prior to the time of cancellation.

Release

By entering, each participant agrees to release and hold harmless YourFreeCandy , their legal representatives, any prize providers, Advertisers and all sponsors and each of their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Promotion or any prize won. Restrictions, conditions, and limitations apply. By entering, each participant further agrees that, in the event there is any conflict or other inconsistency between the Official Sweepstakes Rules and any advertisements, promotional or marketing materials, e-mails, or announcements relevant to this Promotion, these Official Sweepstakes Rules will govern.

Disqualification

YourFreeCandy and any affiliated companies, promotional and advertising agencies, Advertisers and / or prize providers, are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or Computer or telephone transmissions or technical failure, lost e-mail entries, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of this Promotion, as solely determined by the judges, will be disqualified. If disqualified for any of the above reasons, YourFreeCandy reserves the right to terminate player's eligibility to participate in this Promotion. In the event any portion of this Promotion is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of YourFreeCandy which, in the sole opinion of YourFreeCandy , corrupts, or impairs the administration, security, fairness or proper play of the Promotion, YourFreeCandy reserves the right at its sole discretion to suspend or terminate this Promotion or any part of the Promotion, or to roll all entries into the next Sweepstakes period, or any combination of the above. YourFreeCandy , and any affiliated companies, promotional and advertising agencies, Advertisers and / or prize providers are not responsible for any problem with entries generated by computer hardware or software malfunction, error or failure, whatever the cause, including but not limited to, any hardware, software, microchip or other problem(s) experienced by entrants or YourFreeCandy caused by the change of calendar year to 2000, or any other generically termed Y2K problem. YourFreeCandy 's sole responsibility for any irregular entry is replacement with another entry. If a potential winning entry is made by Internet or other computer entry, that potential winner may be required to provide YourFreeCandy with proof that the potential winner is the authorized account holder of the electronic mail address associated with the potential winning entry. WebTV users may experience technical problems that may prevent them from registering and/or playing YourFreeCandy As such YourFreeCandy hereby disclaims any responsibility for incomplete WebTV registrations and/or entries.

Legal Warning

Any attempt by any individual, whether or not a entrant, to damage, destroy, tamper with or vandalize this website, or otherwise interfere with the operation of this Promotion, is a violation of criminal and civil law and YourFreeCandy will diligently pursue all remedies in this regard against any offending individual or entity to the fullest extent permissible by law.

Disputes:

The laws of the United States and the State of New York govern this Sweepstakes. As a condition of participating in the Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with the Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively, by arbitration, located in New York County, New York. Arbitration shall proceed under the rules of the American Arbitration Association then in effect.
